Clearinghouse for Drug Testing

The Federal Motor Carrier Administration (FMCSA) is establishing the Commercial Driver’s License (CDL) Drug and Alcohol Clearinghouse (Clearinghouse). This new database will contain information pertaining to violations of the U.S. Department of Transportation (DOT) controlled substances (drug) and alcohol testing program for holders of CDLs.   
The Clearinghouse rule requires FMCSA-regulated employers, Medical Review Officers (MROs), Substance Abuse Professionals (SAPs), consortia/third party administrators (C/TPAs), and other service agents to report to the Clearinghouse information related to violations of the drug and alcohol regulations in 49 Code of Federal Regulations, parts 40 and 382 by current and prospective employees.

Transgender Observed Drug Testing

"The ODAPC is currently investigating the process to determine the gender of the collector for direct observation collections of transgender donors.  At this time, the observer should be the same gender as the gender that the donor identifies themselves to be.  Example: If a driver identifies themselves as female, then the  observer would be female." 

This rule only applies to the observer of a direct observation collection. A collector does not need to be the same gender as the donor, unless the collection is performing a direct observation collection. For other types of collections, the gender of the observer/collector is not an issue.our post here.

A federal grand jury returned a 25-count indictment,charging a California woman for falsifying commercial driver drug test results.Demetri Dearth, 56, faces charges of mail fraud and false statements to agovernment agency, according to the U.S. Attorney’s Office for the EasterDistrict of California. According to the indictment, Dearth was the owner andoperator of Advanced Programs based in Redding. Dearth purported to assistemployers of commercial drivers to comply with United States Department ofTransportation regulations requiring pre-employment and random drug tests ofcommercial drivers.

On May 1st, trucker Exam Inc. officials unveiled the newMobile CDL Medical Exam and Drug Testing, the first vehicle of its kind to goto transportation companies to do certified CDL Medical exam.
 
The 34-foot long custom-built vehicle has one private examrooms, a lavatory and a waiting area.
 
One to two employees will staff the vehicle, which willserve transportation industry of California and offer blood pressure checks,diabetes tests, CDL Medical Exam and Drug Testing.

What are the rules for pre-employment drug and alcohol testing in commercial drivers?

Subpart C - Tests required -Part one

§ 382.301Pre-employment testing.(a) Prior to the first time a driver performs safety-sensitive functions for an employer, the driver shall undergo testing for controlled substances as a condition prior to being used, unless the employer uses the exception in paragraph (b) of this section. No employer shall allow a driver, who the employer intends to hire or use, to perform safety-sensitive functions unless the employer has received a controlled substances test result from the MRO or C/TPA indicating a verified negative test result for that driver.

Controlled Substances and Alcohol Use and Testing

Who must be tested?
  • All drivers, including part-time, holding a commercial driver's license (CDL) and operating CMVs (greater than 26,000 combined gross vehicle weight rating, or transporting more than 16 passengers, or placarded hazardous materials) on the public roadways must be U.S. Department of Transportation (DOT) drug and alcohol tested. This means any driver required to possess a CDL, including:
    • Drivers employed by Federal, State, and local government agencies.
    • Owner operators.
    • Equivalently licensed drivers from foreign countries.
